A Seminar to Discuss the Study on the Brazilian Legal Framework on Geographical Indications (GIs) was held on 18-20 June at the INPI (National Institute of Intellectual Property). The event in Rio de Janeiro is part of the project under the European Union-Brazil Sector Dialogues Support Facility. For three days, five key themes were discussed: legal concepts and requirements, title (applicants) and expiration (cancellation), ownership, legal protection, and post application changes.
During the opening session, INPI President Luiz Otavio Pimentel mentioned that thanks to the European Union GI practices have been enhanced. Pimentel also stressed the importance of the role played by the Ministry of Agriculture, Livestock and Food Supply (MAPA) in strengthening supply chains, and the role of Sebrae in providing an interface between small and medium producers.
MAPA's Head of Suply Chain and Production Development Pedro Alves Corrêa Neto discussed the importance of Brazil using GIs as a value-adding and differentiation tool for its products in the various markets. Miguel Carvalho, an official with the Department of Innovation and Industrial Property at the Ministry of Industry, Foreign Trade and Services (MDIC) thinks that the actions carried out by INPI, MAPA and Sebrae are positive, and said that it is essential that Brazilian GIs have a strategy to reach the international market.
Hulda Oliveira Giesbrecht emphasised Sebrae’s promotion of GIs in Brazil, and thanked INPI for its collaboration and for satisfying the requirements of producers. Then consultant Liliana Locatelli presented a comparative study of European and Brazilian legislations on GIs.
The seminar was attended by consultants and representatives from the Sector Dialogues Facility, officials from the MDIC, MAPA, World Intellectual Property Organisation (WIPO), INPI, IBGE, National Industrial Confederation (CNI), National Agriculture Confederation (CNA), Sebrae, Embrapa Café, Embrapa Uva e Vinho, Brazilian Cachaça Institute, Brazilian Wine Institute, and some Brazilian GIs such as Alta Mogiana.
On the last day (20/06), delegates drafted a document on recommendations to improve the legislation and legal standards on Brazilian GIs.
